These Terms & Conditions explain how Essential Marketing UK works with clients when providing website, branding, design and marketing services.

We have written these terms in straightforward language so that both Essential Marketing UK and our clients understand what is agreed before a project begins.

By accepting a quotation, approving a project or asking us to start work, you agree to these Terms & Conditions.

1. Our Services

Essential Marketing UK provides digital and marketing services for self-employed professionals, tradespeople and small businesses.

Our services may include:

  • Website design and development
  • WordPress website setup and design
  • Business branding and logo design
  • Business cards and printed marketing materials
  • QR code and Google Review QR code design
  • Social media graphics
  • Promotional and digital marketing materials
  • Other services agreed with the client

The exact services included in your project will be confirmed before work starts.

2. Agreed Price

Before starting a project, we will confirm the services included and the agreed price.

The agreed price covers the work discussed and included in the original project.

If you request additional work, extra pages, new designs, major changes or services outside the original agreement, we will discuss the additional cost with you before carrying out that extra work.

3. Payment

50% of the agreed project price must be paid before work starts.

The remaining 50% is normally payable when the agreed work is completed and ready for final approval, unless another payment arrangement has been agreed.

Work will normally begin once the initial payment and the information reasonably required for the project have been received.

4. WhatsApp Communication

Once your project starts, WhatsApp will be the main communication channel between Essential Marketing UK and the client from the start of the project through to completion.

We will use WhatsApp to:

  • Share project progress
  • Send designs, drafts and proofs
  • Request information
  • Receive feedback
  • Discuss changes
  • Obtain approvals
  • Keep you informed about your project

The work will normally be shared stage by stage, allowing you to review the project as it develops.

The client is responsible for regularly checking WhatsApp and responding when information, feedback or approval is required.

5. Stage-by-Stage Approval

When a stage of the project is shared through WhatsApp, the client should carefully review the work and either approve it or clearly explain what needs to be changed.

The client will normally have three working days to provide approval or request changes.

If no response is received within three working days, the work may be treated as approved and finalised, and Essential Marketing UK may proceed to the next stage.

If you need additional time, please let us know before the three-working-day period ends.

6. Client Information

The client is responsible for providing accurate and up-to-date information for their project.

This may include:

  • Name and business name
  • Telephone number
  • Email address
  • Business address
  • Website address
  • Social media details
  • Prices
  • Opening hours
  • Service information
  • QR codes and links
  • Other personal or business information

Please carefully check all information before approving the work.

7. Printed Materials and Final Proofs

For printed materials such as business cards, flyers, leaflets, posters, signs and other promotional materials, we will normally provide a digital or printable proof before printing.

It is the client’s responsibility to carefully check the proof before giving approval.

The client should check all names, business details, telephone numbers, email addresses, website links, prices, QR codes, spelling and other information.

Once the client approves the final proof for printing, Essential Marketing UK will use the approved version for production.

If an error, spelling mistake or incorrect personal or business information that was present in the approved proof is discovered after printing, any additional redesign, reprinting or replacement costs may be charged to the client.

We strongly recommend checking the final proof carefully before giving printing approval.

8. Changes and Revisions

Reasonable changes to work included within the original agreement can be discussed during the project.

A major change to the original brief, a completely new design direction, additional pages, additional materials or new services may be considered additional work.

Any additional cost will be discussed before the extra work is carried out.

9. Website Projects

For website projects, the client is responsible for providing accurate business information, photographs, logos, service details, prices and other content they wish to use.

Where agreed, Essential Marketing UK may assist with website content, layout and presentation.

Website projects may involve third-party services such as WordPress, hosting, domain providers, plugins, themes, Google services or other platforms.

Separate third-party charges, subscriptions or renewals are the client’s responsibility where applicable and will be explained where reasonably possible.

10. Client-Provided Content

The client remains responsible for photographs, text, logos, trademarks and other materials supplied to Essential Marketing UK.

By providing material for use in a project, the client confirms that they have the necessary permission or rights to use it.

Essential Marketing UK is not responsible for copyright or ownership disputes relating to material supplied by the client.

11. Third-Party Services

Some aspects of a project may depend on third-party companies or platforms.

These may include website hosting, domains, WordPress, Google, social media platforms, printing companies, QR code services, fonts, images or other software.

Third-party services may have their own prices, licences, terms, policies and technical limitations.

Essential Marketing UK cannot guarantee the continued availability or performance of services that are outside our reasonable control.

12. Project Timescales

We will provide an estimated timescale where reasonably possible.

A project may take longer if there are delays involving client information, feedback, approvals, changes, third-party services, printing, technical issues or circumstances outside our reasonable control.

We will try to keep the client informed of significant delays.

13. Cancellation by the Client

If you wish to cancel a project, please contact Essential Marketing UK as soon as possible.

Where work has already been completed or genuine costs have been incurred, these may be taken into account when considering any amount due or refund.

Any cancellation charge or amount retained will be reasonable and related to work completed or actual costs or losses arising from the cancellation.

Nothing in these terms is intended to remove or reduce any cancellation or other legal rights that apply to a consumer. (GOV.UK⁠)

14. Refunds

If a refund is appropriate, it will be considered based on the circumstances of the project, work already completed, costs incurred and applicable law.

Nothing in these Terms & Conditions removes or limits statutory consumer rights.

15. Our Responsibility

Essential Marketing UK will provide its services with reasonable care and skill.

We aim to deliver work according to the agreed requirements.

However, we cannot guarantee specific business results such as:

  • A particular Google ranking
  • A specific number of website visitors
  • A specific number of enquiries
  • Increased sales
  • Social media growth
  • A particular number of reviews
  • Guaranteed business growth

Marketing results can depend on many factors outside our control.

16. Website Availability

After completion, a website may depend on hosting providers, domain providers, WordPress, plugins, internet services and other third parties.

We are not responsible for interruptions caused by circumstances or services outside our reasonable control.

17. Portfolio Use

We may wish to show completed work as an example of our services.

Where a project contains confidential information, we will take reasonable care when displaying examples.

If you have a specific concern about your project being used as a portfolio example, please discuss this with us.

18. Complaints

If you are unhappy with our service, please contact us first and explain the issue.

We will review your concerns fairly and, where reasonably possible, try to put things right.

19. Privacy

Personal information provided to Essential Marketing UK will be handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use and protect personal information.

20. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services or legal requirements.

For a particular project, the version applicable when the project is agreed will normally apply, unless a change is required by law or otherwise agreed with the client.

21. Legal Rights

Nothing in these Terms & Conditions is intended to remove or restrict any legal rights that a client has under applicable UK law.

Where a client is a consumer, applicable consumer protection legislation continues to apply.

Services supplied to consumers must be carried out with reasonable care and skill, and contractual terms cannot simply remove those statutory rights. (GOV.UK⁠)

22. Governing Law

These Terms & Conditions are intended to be governed by the laws of England and Wales, subject to any mandatory legal rights that apply to the client.
